Partner Terms

These Partner Terms ("Terms") govern participation in the Pakta Partner Program (the "Program"), operated by Qamentum Ltd ("Pakta", "we", "us"). By submitting a partner application, you agree to these Terms.

1. Joining the Program
1.1. To join, submit the application form on the Partnership page. We review every application and may accept or decline it at our discretion, without stating reasons.
1.2. Upon approval, you receive a personal partner code (e.g. ANNA10) and a personal referral link. Your participation begins when you receive them.
1.3. You must be at least 18 years old and legally able to receive payments to the payout method you provide.

2. How referrals are tracked
2.1. A customer is attributed to you if: they place an order after visiting Pakta through your referral link, or they enter your partner code when placing an order.
2.2. If both a referral link and a partner code are present and they differ, the partner code entered by the customer takes priority.
2.3. Attribution is determined by our records. We track referrals in good faith, but we cannot attribute orders where neither the link parameter nor the code was captured (for example, if the customer returned to the site directly and did not enter a code).

3. Commission
3.1. You earn a commission of €15 for each attributed customer's first completed and paid purchase of a Pakta product.
3.2. No commission is paid on: upgrades (e.g. Basic → Pro), any subsequent purchases by the same customer, refunded or cancelled orders, or your own purchases (self-referral).
3.3. Customers who use your partner code receive a €5 discount on their first purchase. This discount does not reduce your commission.

4. Payouts
4.1. Commissions are calculated per calendar month and paid by the 10th day of the following month.
4.2. The minimum payout amount is €50. If your accrued balance is below €50, it carries over to the following month(s) until the threshold is reached.
4.3. Payouts are made via Revolut or bank transfer (SEPA), using the payout details you provided. You are responsible for keeping them accurate.
4.4. A commission becomes payable only after the underlying order is paid in full and is not refunded. We may withhold or reverse commissions for orders that are refunded, cancelled, or flagged as fraudulent.
4.5. You are solely responsible for any taxes, social contributions, or reporting obligations arising from your commissions in your country of residence.

5. What partners may and may not do
5.1. You may promote Pakta through your own channels: websites, blogs, social media, newsletters, communities, and personal recommendations.
5.2. You must not:

• send unsolicited messages (spam) or use misleading, deceptive, or aggressive promotion methods;

• present Pakta as a law firm or as providing legal advice or legal representation — Pakta prepares ready-to-send documents reviewed by a German tenant law attorney; customers act in their own name;

• make guarantees on Pakta's behalf (e.g. promising a specific outcome, refund, or timeframe);

• bid on "Pakta" or confusingly similar terms in paid search advertising, or register domains or social media accounts that imitate Pakta;

• use your code or link to obtain a discount or commission on purchases made by you or on your behalf.

5.3. You act as an independent party. Nothing in these Terms creates an employment, agency, or joint venture relationship, and you may not enter into obligations on Pakta's behalf.

6. Term and termination
6.1. Either party may end participation in the Program at any time, with immediate effect, by written notice (email is sufficient).
6.2. If you materially breach these Terms (in particular Section 5), we may terminate your participation immediately and withhold unpaid commissions related to the breach.
6.3. Upon termination for reasons other than breach, commissions properly accrued before the termination date remain payable under Section 4, including the €50 threshold rule; balances below the threshold at termination are paid out with the final settlement.

7. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email to registered partners at least 14 days before they take effect. Continued participation after the effective date constitutes acceptance. If you do not agree, you may terminate under Section 6.

8. General
8.1. These Terms are governed by the laws of England and Wales, unless mandatory law provides otherwise.
8.2. If any provision of these Terms is found invalid, the remaining provisions remain in effect.
